1 Presentation of the Society
The Society The 19 is a SASU registered under the SIRET number 981 086 424 00018The headquarters of the company are located on Avenue Chaban Delmas, 13300 Salon-de-Provence, France.
Prod19 is specialized in renting high-end mobile logos, prestigious motorhouses, and associated services for shooting, festivals, events and VIP clients.
2 The object
These General Conditions of Service (General Conditions of Service) define the terms under which Prod19 provides its rental and service services to its professional customers.
3 The field of application
The CGPs apply to any order, agreed devis or contract signed with Prod19. Any validation of devis implies the full acceptance of these CGPs.
Proposed benefits
The benefits include in particular:
5 – Order and Device
Any service is subject to a personalized devis.
The devis is valid for a period of 15 days unless otherwise stated.
The order is considered to be firm and final upon receipt of the signed devis accompanied by the requested fee.
Financial Conditions and Facturation
Unless otherwise stated in the case:
70% of the billing of the debt
30% of the balance not later than 30 days before the beginning of the service
Any payment is subject to a bill in accordance with the accepted fee.
Any delay in payment may result in the suspension of the benefits, without prejudice to the amount due.
Annulation, modification and delay
Any cancellation or request for modification must be notified in writing.
The services of Prod19 involve the early reservation of equipment, the immobilization of units and the mobilization of dedicated teams.
The amount paid corresponds to the reservation, preparation and blocking costs of the units.
In case of cancellation, the amount paid does not result in automatic refund.
However, Prod19 may, in exceptional terms and without this constituting an obligation, propose a delay of the service or a commercial gesture, subject to the availability of the material.
Any agreement shall be subject to a written agreement between the parties.
In the absence of agreement, the amount paid remains acquired to Prod19.
8.Customer's obligations
The customer is committed to:
Access to the site and installations areas
Supply the necessary electrical connections
Respect the conditions of use of the equipment
To accept any degradation caused by its teams or stakeholders
9 Responsibility
Prod19 cannot be held liable for delays or obstacles related to cases of force majeure, extreme weather conditions or administrative decisions.
10 Insurance
The product is provided by Prod19.
Any degradation caused by the customer or its stakeholders may be subject to a billing.
11 – Confidentiality
Prod19 undertakes to the strictest confidentiality regarding projects, artists, customers and events.
12 Subcontracts
Prod19 reserves the possibility to use third-party partners or providers for the execution of all or part of the services.
Prod19 guarantees that the equipment supplied has a range and performance level equivalent to its usual standards and remains the only customer interlocutor.
Applied Law and Dispute
The CGP is subject to French law.
Any dispute concerning their interpretation, execution or validity shall be in the exclusive jurisdiction of the courts of the jurisdiction.
The Court of Appeal in Aix-en-Provence.
